Who is required to use a POS terminal?

According to the Resolution dated July 1, 2021, businesses involved in the following types of activities are required to use a POS terminal:

  • Wholesale or retail trade, including the sale of motorcycles and cars, as well as maintenance services.
  • Hotel services.
  • Restaurants and other establishments serving food and beverages.
  • Sale of train and airline tickets.
  • Tour operator services. The only exception is for travel agents, who are not required to use a terminal.
  • Insurance services.
  • Healthcare services.
  • Fitness clubs and others.

What are the consequences of not having a payment terminal?

If your company is legally required to use a terminal but fails to do so, you may face fines. These penalties are regulated by the Code of Administrative Offenses.

If the violation is identified for the first time, the penalty for not having a POS terminal is a warning. If you fail to resolve the issue within a year and the authorities detect the violation again, you will have to pay a fine. The amount of the fine depends on the size of the business. For small businesses, the fine is 40 MCI (in 2025, this equals 157,280 KZT). Medium-sized businesses will pay 60 MCI, or 235,920 KZT. For large companies, the fine reaches 80 MCI (equivalent to 314,560 KZT).
